BC Human Rights Tribunal itself not accommodating for disability?
August 28th, 2010 | by admin |Hi, I currently have a Complaint that was accepted by the Tribunal – Tenancy, failure to accommodate for disability. I have a severe hyperacusis – collpased to sound, Bldg Mgr was told. Now the Tribunal will not accommodate for my disability either – and now I mean, I have very limited mobility because of a fractured ankle and need more surgery. They will not respond with me by email (both because of hyperacusis, and now because, further to their lack of accommodation, I’ve had to add my foot (which has nothing to do with my original complaint). I’m on CPP Disability since 2004, applying for PMD, and as I can’t pay for couriers, process servers, et al, I have to walk and I can’t walk – but if I don’t? they’ll dismiss the complaint. I’ve already sent them the note from the Doctor but now they’ve sent me a Form 8 (apparently there are 2 Form 8’s, 1 for responding to request to Dismiss by Repsondent, and now for accommodation from the Tribunal. I’m worried my leg will give out.
Your apartment bldg manager cannot make any accommodations for your disability because it isn’t a matter of the level of sound – you will hear it loud regardless because due to the nature of your disease your brain is stuck on high volume.
You should perhaps consider making a move out to the country where there is less noise.

Is there a free legal clinic in your area, they will help. If not they will play games and try their best to get out of accomodating your disablility just keep on pushing. Also, I would call the American Bar Association and explain your problem there are many lawyers who take cases for free. Good Luck to You! You can also call you city government office and they can advise you.
